1. Acceptance of Terms and Service Description
By accessing and using Forge ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). Please note that Forge operates as an API provider which utilizes Artificial Intelligence (AI) and Machine Learning (ML) models. We provide a unified routing gateway that allows users to access multiple large language models through a single, OpenAI-compatible endpoint interface. By utilizing our API, you understand that inputs and outputs are processed by AI systems, and you agree to these specific operational paradigms.
2. User Accounts and API Key Security
To use the Service, you must register for an account and generate an API key. You are solely responsible for maintaining the strict confidentiality of your account credentials and API keys. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Forge will not be liable for any loss or damage arising from your failure to comply with this security obligation. You are responsible for all activities that occur under your account, including any API usage fees incurred.
3. Credits, Billing, and Payments
Forge operates on a prepaid credit-based system. Credits are purchased and subsequently consumed based on your API usage, measured in tokens or request volume. All sales of credits are final, non-refundable, and non-transferable unless explicitly required by applicable law. If your account balance falls below zero, we reserve the right to immediately suspend API access until the balance is replenished. We may change our pricing and billing methods at any time upon notice.
4. Acceptable Use and Restrictions
You agree to use the API strictly in accordance with all applicable laws and regulations. You shall not use the Service to: (a) generate, promote, or distribute any unlawful, harmful, defamatory, or explicit content; (b) violate the intellectual property rights or privacy of others; (c) attempt to reverse engineer, decompile, or bypass any rate limits or security measures of the Service; (d) use the AI models to make automated decisions that have legal or significant effects on individuals without human oversight; or (e) knowingly send malicious payloads or spam through our routing gateway.
5. AI Output and Content Ownership
As between you and Forge, you retain all rights to the data you input into the Service ("Input"). You are also assigned any rights Forge has to the generated data returned by the Service ("Output"). However, due to the nature of machine learning, you acknowledge that Output may not be unique across users and that the Service may generate the same or similar output for others. Forge makes no representations regarding the copyrightability of the Output.
6. Disclaimer of Warranties
The Service, including the API and all AI model outputs, is provided strictly on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Forge disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that the AI outputs will be accurate, reliable, or safe for your specific use case.
7. Limitation of Liability
To the maximum extent permitted by law, Forge and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your access to or use of the Service. In no event shall our aggregate liability exceed the total amount paid by you to Forge for the Service during the three (3) months preceding the claim.
8. Indemnification
You agree to defend, indemnify, and hold harmless Forge, its officers, directors, and employees from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including any copyright, property, or privacy right relating to your Inputs or Outputs.
9. Modifications to the Service and Terms
We reserve the right to modify or discontinue the Service (or any part thereof) temporarily or permanently with or without notice. We may also update these Terms from time to time. We will notify you of material changes. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. You explicitly agree to accept and be bound by all changes and modifications made by Forge, regardless of the outcome or impact on your usage.
